These Terms & Conditions ("Terms") govern your access to and use of the website, client portal, and marketing/CRM/communication tools provided by IntelliTech Dynamics LLC ("we," "us," "our"), including at intellitechdynamics.com and any branded subdomains (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
IntelliTech Dynamics LLC provides marketing, customer relationship management (CRM), and communication tools — including web forms, scheduling/calendars, email campaigns, and SMS text messaging — to businesses ("Clients") and, in turn, to the customers and contacts of those Clients. Some features are delivered through white-labeled software infrastructure branded to appear as our own platform.
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
This section applies to anyone who opts in to receive text messages from IntelliTech Dynamics LLC or from a Client using our Services.
By opting in, you may receive text messages such as appointment reminders and confirmations, account and service notifications, customer support replies, and, where you have separately agreed, promotional or marketing messages. Message frequency varies based on your interactions and the sender's program.
You opt in to receive text messages by submitting your mobile number through a form, checkbox, keyword, or other opt-in method that clearly discloses you will receive recurring text messages. Consent to receive text messages is not a condition of purchasing any goods or services.

Supported carriers are not liable for delayed or undelivered messages. Text messaging is subject to the terms of your mobile carrier, and message and data rates from your carrier may apply.

Fees for the Services, if applicable, are described at the time of purchase or in your service agreement with us. Fees are billed in advance on a recurring basis unless stated otherwise, and are non-refundable except as required by law or as separately agreed in writing.
The Services, including all software, branding, text, and design elements, are owned by IntelliTech Dynamics LLC or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services as permitted by these Terms. You retain ownership of content and data you submit through the Services.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that messages will be delivered successfully.
To the fullest extent permitted by law, IntelliTech Dynamics LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve (12) months preceding the claim.
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason, with or without notice. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Galveston, TX, unless otherwise required by applicable law.
We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the "Last updated" date above. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
